Additional information
This course is not designed to help you understand mental health issues per se although it will help you understand what is meant by the term 'mental disorder'. It will help you understand how the new 2007 Act relates to other relevant legislation such as the Mental Capacity Act 2005 and the existing Mental Health Act 1983, and provides pertinent case studies which help you decide which legislation to apply.
The Mental Health Act 2007 course covers new rules regarding treatment in the community, revised rules about "nearest relative" and changes to a number of definitions and applicable criteria. It also includes a new Code of Practice and, following the Bournewood Case, new guidance regarding the deprivation of liberty.
Learning Objectives
On completion of this course learners will be able to:
- describe the five core principles of the Act
- describe the assessment process for establishing capacity
- identify the key elements of consultation and engagement when establishing a person's best interests
- apply the procedures for resolving disputes
- identify where their organisation needs to modify its policies to include the provisions of the Act
